Nagle Station alleges companies failed to properly inspect tanks at gas station site

CHICAGO – The owner of a gas station in Harwood Heights alleges three companies failed to properly inspect the underground storage tanks at the property.

Nagle Station LLC filed a complaint on Oct. 10 in Cook County Circuit Court against Tanknology Inc., Anderson Pump Services Inc. and B & K Equipment Co. alleging negligence.

According to the complaint, the plaintiff purchased a Harwood Heights gas station in November 2013 that contains underground storage tanks and an underground storage system. The suit states prior to the purchase, B&K removed four dispensers and plugged product lines at the site and re-installed the dispensers in January 2014. The suit states the same month, Tanknology inspected the storage tanks and Anderson Pump made certain repairs a few months later.

In November 2014, the suit states a complaint was filed against the plaintiff by parties who allege gasoline is leaking from the plaintiff's site.

The plaintiff alleges the defendants failed to properly inspect the tanks for defects, deterioration or leaks, and failed to timely notify the proper entities of the dangerous and defective condition of the tank system.

The plaintiff seeks judgment for damages of more than $100,000 for physical damages, loss of value of the site, and other relief. It is represented by Ryan Sullivan and Gary Klinger of Kozonis Law LTD in Chicago.
