Widow alleges negligence of Professional Home Care Advantage caused husband's death

CHICAGO – A widow is seeking damages from home health service company over allegations its negligence caused her husband's 2013 death.

Ernesta Ware, individually and as independent administrator of the estate of Ceasar Ware, filed a complaint on Oct. 12 in Cook County Circuit Court against Professional Home Care Advantage Inc., citing the Wrongful Death Act.

According to the complaint, between March 26-May 2, 2013, Ceasar Ware was receiving care from the defendants following his discharge from a hospital. The suit states on May 2, 2013, Ware's family contacted the defendants to report he was constipated, sweating and in pain and that the defendants responded they would visit him that morning to treat his condition.

The suit states Ware lost consciousness that day while attempting to have a bowel movement at the defendants' instructions and died the same day of cardiac arrest.

The plaintiff alleges the defendants failed to properly treat, examine and care for Ware's constipation and bowel condition, and failed to order or recommend emergency treatment when it was medically necessary to do so.

The plaintiff seeks judgment in an amount of more than $50,000. She is represented by Stephanie K. Nathanson and Michael T. Peterson of Law Offices of Stephanie K. Nathanson in Chicago.
