Guardians allege Symphony of Lincoln Park failed to protect disabed resident from falls

CHICAGO – The guardians of a disabled person are suing a Chicago long-term care facility over allegations it failed to protect a resident from falls.

Lydia Taylor and Lilian Rice, as guardian of Lizette Hopkins, filed a complaint on Oct. 15 in Cook County Circuit Court against Symphony of Lincoln Park, over alleged violation of the Illinois Nursing Home Care Act.

According to the complaint, since Aug. 9, 2017, Hopkins has been a resident of the defendant's facility for the purposes of residential nursing care, rehabilitation and assistance with activities of daily living. The plaintiffs allege the defendant was aware Hopkins was a high fall risk and required supervision, and the suit states Hopkins suffered five falls from August 2017 to September 2018.

The plaintiffs seek judgment in an amount of more than $50,000, plus attorney fees and costs. They are represented by Katherine A. Cardenas and Khalid Hasan of Lucas and Cardenas PC in Chicago.
