RLI Insurance alleges it as no duty to indemnify Insight Consulting Group in fax suit

CHICAGO – An insurer is asking a court to declare it has no duty to indemnify a Cook County business in a lawsuit over a fax.

RLI Insurance Co. filed a complaint on Oct. 19 in Cook County Circuit Court against Insight Consulting Group LLC and Associated Management Services Inc. seeking declaratory judgment.

According to the complaint, the plaintiff alleges on Oct. 3, Insight provided it notice of a demand letter sent to it from Associated. Associated alleged it received a fax from Insight that violated the Telephone Consumer Protection Act.

The plaintiff alleges the policy it issued to Insight contains a consumer protection law exclusion and it has no duty to pay for Insight's defense.

The plaintiff seeks judgment against defendant for damages, declaratory relief and all such just and equitable relief, and costs of suit. It is represented by Michael T. Skoglund and Abigail E. Rocap of BatesCarey LLP in Chicago.
