Daughter files wrongful death suit against Symphony of Chicago West

CHICAGO – A woman has filed a suit against a nursing facility over her mother's death.

Cheryl Smith, as independent administrator of Mildred Smith, filed a complaint on Oct. 12 in Cook County Circuit Court against Symphony of Chicago West and Maestro Consulting Services LLC, citing the Nursing Home Care Act, the Wrongful Death Act and other counts.

According to the complaint, Mildred Smith resided at Symphony intermittently from June 2013 to June 2016. The suit states on June 3, 2016, a nurse administered Smith's breathing treatment and the nurse found Smith unresponsive a few minutes later. Smith was pronounced dead the same day.

The plaintiff aleges the defendants failed to timely notify Smith's physician of changes in her condition, failed to properly respond to significant changes in her condition and failed to timely transfer her to an acute care facility.

The plaintiff seeks judgment against defendants for an amount in excess of the court's limit, compensatory damages, costs and attorney's fees. She is represented by Paul D. Richter and Caitlin K. Finnegan of Kralovec, Jambois & Schwartz in Chicago.
