Oak Park, Westchester nursing homes sued over death of patient

CHICAGO — The estate of a man who died after living in two Illinois nursing homes is suing the homes over their allegedly negligent care and supervision.

Erica Emery, as the independent administrator of the estate of Leonard Calvert, filed a complaint on Oct. 15 in Cook County Circuit Court against Paramount of Oak Park Rehabilitation and Nursing Center and Westchester Health and Rehabilitation Center for allegedly violating the Nursing Home Care Act.

Calvert was transferred to hospitals several times in 2016 and 2017 with rashes and other ailments, and was eventually diagnosed with sepsis, small bowel obstruction, acute renal failure, severe dehydration, malnutrition and elevated troponins before passing away at a hospice, the complaint said.

The plaintiff said the defendants had failed to notify Calvert's physician of changes in his condition and failed to provide adequate and properly supervised nursing care and personal care.

The plaintiff requested a trial by jury and compensation for the injuries, losses and damages. She is represented by Benjamin Carter of Kralovec, Jambois & Schwartz in Chicago.
