Goodyear, General Motors sued by driver whose car overturned

CHICAGO — A driver whose vehicle overturned after one of his tires failed, causing permanent injury, is suing Goodyear and General Motors for allegedly selling unreasonably dangerous products.

Moises Gama filed a complaint on Oct. 18 in Cook County Circuit Court against Goodyear Tire & Rubber, General Motors, his car dealer, mechanic and others, alleging the defendants had breached their duty to refrain from designing, manufacturing, selling, distributing, and placing into the street products that were unreasonably dangerous and unsafe.

Gama said he was driving his 2006 GMC Yukon when his driver's side rear tire partially delaminated while in use, and the vehicle went out of control, struck a guardrail and overturned, causing permanent and serious bodily injuries.

He alleged that the defendants had failed to warn him and others that the tires could fail during normal use and failed to exercise reasonable care in the design, manufacture, sale, assembly or distribution of the product.

The plaintiff requested a trial by jury, seeking at least $50,000, plus the cost of bringing the suit. He is represented by Richard Prendergast, Michael Layden and Collin Bruck of Richard J. Prendergast in Chicago.
