State Farm accuses woman of intentionally damaging car to claim injuries from a hit-and-run

CHICAGO – An insurance company alleges a woman intentionally damaged her vehicle and filed a false claim stating she and her grandchildren were injured in a hit-and-run collision.

State Farm Mutual Automobile Insurance Co. filed a complaint on Oct. 19 in Cook County Circuit Court against Taya Martin.

According to the complaint, Martin claimed her vehicle was struck by an unidentified driver who fled the scene on Jan. 13, and alleged she and two children in her care were injured in the collision. The suit states the defendants made claims for uninsured motorist coverage and medical payments.

The plaintiff alleges the defendants were not involved in a hit-and-run accident, but instead Martin's vehicle was intentionally damaged. State Farm alleges Martin made false statements with the intent to conceal or misrepresent facts.

The plaintiff seeks declaratory judgment declaring it has no duty to arbitrate any claim and other relief as the court deems just. It is represented by Brent D. Tinkham of Taylor Miller LLC in Chicago.
