CHICAGO – A Kane County couple alleges they suffered respiratory injuries as a result of exposure to two chemical food additives.
Lazaro Sanchez Jr. and Patricia Bustamante filed a complaint on Oct. 22 in Cook County Circuit Court against DSM Food Specialties USA Inc., Fona International Inc., O'Laughlin Industries Inc. and others alleging strict liability and other counts.
According to the complaint, both plaintiffs have worked in manufacturing involving diacetyl and acetyl propionyl, which are chemical food additives. The suit states these additives are "severely toxic and poisonous" when used independently and can cause damages to the respiratory system.
The plaintiffs allege the exposure to the additives caused them to sustain respiratory injuries.
The plaintiffs allege the defendants allegedly designed, marketed and sold the additives without adequate instructions on safe use.
The plaintiffs request a trial by jury and judgment of more than $50,000, plus costs of suit, and any other relief which the court may deem appropriate. They are represented by Jacob W. Plattenberger, Kenneth J. Brennan and Tyler J. Schneider of TorHoerman Law LLC in Chicago.
