CHICAGO – A couple alleges a physician failed to timely schedule a revision surgery to address issues with a previous surgery on the husband's spine.

A. Stewart Winston II and Victoria Winston filed a complaint on Oct. 19 in Cook County Circuit Court against physician Leslie Schaffer, Neurosurgical Professionals LTD, and others, alleging medical malpractice.

According to the complaint, on Nov. 3, 2016, A. Stewart Winston II underwent a spinal surgery at defendants' medical center, performed by Schaffer.

However, on Dec. 3, 2016, the suit states a post-operative CT scan showed "lucency around the tip of the left C6 transpedicular screw which may indicate loosening."

The plaintiffs allege the defendants failed to decompress and fuse Winston's spine and failed to timely perform revision surgery.

The plaintiffs seek judgment for a sum of money in excess of the jurisdictional limit for the Law Division of the Cook County Circuit Court. They are represented by Michael T. Gill of Pfaff, Gill & Ports LTD in Chicago.
