Consumer files suit against Southwaste Disposal, Waste Resource Management over sales call

CHICAGO – Two companies based in Houston are alleged to have unlawfully called an Illinois man to solicit their services.

Dr. Fred Turk filed a class action complaint on Nov. 8 in Cook County Circuit Court against Southwaste Disposal LLC, Waste Resource Management Inc. and John Does 1-10 citing the Illinois Automatic Telephone Dialers Act.

According to the complaint, the plaintiff received a cellphone call on April 24 from the defendants offering their services. He alleges he has no prior relationship with the defendants and did not authorize the calls to his phone.

The plaintiff alleges the defendants unawfully used an automatic telephone dialing system and communicated with plaintiff without prior express consent to place the calls.

The plaintiff seeks judgment against defendant for statutory damages, attorney fees, litigation expenses and costs of suit. He is represented by Daniel A. Edelman, Cathleen M. Combs and Heather Kolbus of Edelman, Combs, Latturner & Goodwin LLC in Chicago.
