CHICAGO – A resident of a Cicero care facility alleges it failed to protect her from falls.

Linda Kines, individually and through her next friend Aysha Kines, filed a complaint on Nov. 5 in Cook County Circuit Court against Alden-Town Manor Rehabilitation and Health Care Center Inc. and affiliated entities for alleged violation of the Illinois Nursing Home Care Act.

According to the complaint, on Feb. 24, 2016, Linda Kines was admitted at defendants' nursing facility and was assessed as high risk for falls and required assistance with ambulation and the use of assistance devices to prevent falls and injuries from falls.

The suit states Linda Kines fell Nov. 8, 2016, and was diagnosed with a femur fracture Nov. 14, 2016, that required surgery.

The plaintiff seeks judgment in an amount exceeding $50,000 plus costs. She is represented by Kyle R. Kasmarick of Syregelas & Kasmarick LLC in Chicago.
