Property buyers allege broker failed to disclose Tri-State Tollway project plans before purchase

CHICAGO – The buyers of a Western Springs property allege a broker sold them a property without disclosing a massive highway construction project was planned near it.

John Starr and Jacqueline Starr filed a complaint on Nov. 2 in Cook County Circuit Court against Robby Bartholomai and Smothers Realty Group alleging common law fraud, negligent misrepresentation and other counts.

According to the complaint, the plaintiffs own a property in Western Springs and the defendants represented them when they purchased it in July for $440,000. They allege after they closed on the property, they learned there was a "massive" construction project planned around the property for the Central Tri-State Tollway. They allege had they known of the project, they would not have purchased the property.

The plaintiffs hold Bartholomai and Smothers Realty Group responsible because the defendants allegedly omitted key information about the construction surrounding the property to induce plaintiffs to purchase the property.

The plaintiffs seek judgment against the defendants in an amount of more than $30,000, plus punitive damages, attorney fees and costs. They are represented by Mason Cole of Cole Sadkin LLC in Chicago.
