Lakeshore Historic District property owners seek review on home plan approval

CHICAGO – Property owners in Evanston's Lakeshore Historic District are seeking review in a matter over new construction in the district.

Philip J. Crihfield, Jacqueline A. Crihfield, and others, filed a complaint on Nov. 13 in Cook County Circuit Court against the city of Evanston, Evanston Preservation Commission, Adam Sabow and Sue Sabow seeking administrative review and declaratory judgment.

According to the complaint, the Sabows own a vacant lot on Edgemere Court in Evanston and the plaintiffs own adjacent lots that have been designated as landmarks. The suit states all of the properties on Edgemere Court are within a designated historic district and are under rules and procedures that must be followed for the construction of a new home.

The suit states the Sabows applied for a certificate of appropriateness before constructing a home on their lot in 2016, then submitted a new application in 2018 for a new design. The suit states the Evanston Preservation Commission ruled the application of the proposed structure did not meet the required standards and the Sabows appealed. The application was approved at an Oct. 9 hearing.

The plaintiffs allege the defendants failed to follow its own procedures and correctly apply its own standards and deprived plaintiffs of due process.

The plaintiffs seek judgment against defendants for declaratory and injunctive relief and other relief as the court may find equitable and appropriate. They are represented by Thomas W. Conklin Jr. of Conklin & Conklin LLC in Chicago.
