Illinois State Bar Association Mutual Insurance says shouldn't need to defend lawyer vs lawsuit

CHICAGO – A Chicago insurance company is seeking a declaration that it has no duty to defend a law firm against a lawsuit filed in a federal district court.

Illinois State Bar Association Mutual Insurance Co. filed a complaint on Nov. 19 in Cook County Circuit Court against James G. Pesoli, JGP Law LLC and Sundip Bhundia seeking declaratory judgment.

According to the complaint, the plaintiff issued a policy of professional liability insurance to JGP Law. Bhundia filed a lawsuit against the law firm in the U.S. District Court for the Northern District of Illinois regarding an investment agreement. 

The plaintiff alleges it has no duty to defend JGP Law as the policy excludes coverage for damages resulting from investments.

The plaintiff seeks declaratory judgment that plaintiff has no duty to defend Pesoli and JGP Law LLC, reasonable costs, and further relief. It is represented by Robert Marc Chemers of Pretzel & Stouffer in Chicago.
