Niece files suit against Belmont Village Senior Living Oak Park over late uncle's fall

CHICAGO – A woman is seeking damages from an Oak Park nursing facility over a fall her late uncle had there.

Kathleen Monty, as independent administrator of the estate of Richard J. McCarthy, filed a complaint on Dec. 4 in Cook County Circuit Court against Belmont Village Senior Living Oak Park, and related entities, alleging negligence and other counts.

According to the complaint, the plaintiff alleges that while McCarthy was still a resident of defendants' Oak Park facility, he fell in December 2016, resulting in a hip fracture and leg fracture. The suit states he died Feb. 21, 2017, and resided at the defendants' facility from June 1, 2015, to Dec. 23, 2016.

The plaintiff alleges the defendants failed to protect McCarthy from neglect, failed to appropriately assess his fall risk, failed to provide him with working alarms to alert the staff if he attempted to move about without assistance, and failed to have sufficient nursing staff.

The plaintiff requests a trial by jury and seeks judgment against defendant of more than $50,000. She is represented by Susan L. Novosad and Gabriel J. Aprati of Levin & Perconti in Chicago.
