CHICAGO – A Chicago woman is seeking damages from a hospital and medical staff after her child was stillborn.
Irene D. Martinez filed a complaint on Dec. 4 in Cook County Circuit Court against St. Anthony Hospital and two nurses, alleging negligence.
According to the complaint, on Dec. 4, 2016, the plaintiff went to St. Anthony Hospital complaining of cramping, contractions and labor pains, but was discharged after testing and instructed to return home and remain hydrated.
The suit states the plaintiff returned to the hospital on Dec. 7, 2016, with complaints of cramping and loss of detectable fetal movement. The suit states a stillborn baby was delivered via Caesarian section and the cause of death was determined to be acute chorioamnionitis and other issues.
The plaintiff alleges the defendants failed to properly interpret the fetal heart rate and failed to admit the plaintiff for observation.
The plaintiff requests a trial by jury and seeks judgment against the defendants of more than $50,000, plus costs of suit. She is represented by James W. Mertes of Mertes & Mertes PC in Sterling.
