Wrongful death suit filed against Aperion Care, others over resident's death

CHICAGO – An estate administrator alleges an Oak Lawn care facility failed to protect a woman from developing pressure sores.

Richard Portis, independent administrator of the estate of Ruby Elaine Jenkins, filed a complaint on Dec. 11 in Cook County Circuit Court against Concord Nursing and Rehabilitation Center LLC, Aperion Care Inc., and others, alleging negligence, wrongful death and other counts.

According to the complaint, Jenkins was a resident of Aperion Care Oak Lawn from November 2016 to January 2018. While there, the suit states Jenkins suffered from multiple pressure sores that contributed to her Feb. 26 death.

The plaintiff alleges defendants failed to allocate sufficient resources to adequately staff the facility, failed to provide adequate medical and personal care and failed to timely notify Jenkin's physician and family regarding changes in her condition.

The plaintiff requests a trial by jury and seeks judgment against defendants of more than $50,000. He is represented by Caroleann S. Gallagher and James E. Coogan of Dwyer & Coogan PC in Chicago.
