CHICAGO – A JetSmarter member alleges he sustained more than $90,000 in damages when the company changed its terms of use.
Edward Liceaga filed a complaint on Dec. 6 in Cook County Circuit Court against JetSmarter alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges on August 2017 he was contacted by a JetSmarter representative to renew his membership and purchase a more expensive one. The suit states the plaintiff purchased the Sophisticated Membership in September 2017.
In October 2017, the suit states Liceaga was unable to book a flight through the JetSmarter app and was told by the defendant that the terms and conditions had changed.
The plaintiff seeks an amount of $94,791.67, plus punitive damages, attorney fees, costs, and further relief. He is represented by Cervantes Chatt & Prince P.C in Burr Ridge.
