Wrongful death suit filed against Blue Island, Posen over police chase death

CHICAGO – Blue Island and Posen are facing a wrongful death suit filed by the administrator of a pedestrian who died during a police pursuit in November.

Angela Preusser, as special administrator of the estate of Francis Mihalovitz, filed a complaint on Dec. 11 in Cook County Circuit Court against the city of Blue Island; unknown officers and the village of Posen alleging wrongful death.

According to the complaint, on Nov. 30, Blue Island and Posen police pursued a suspect at a high rate of speed. The suit states Mihalovitz was a pedestrian on the east side of Western Avenue near the intersection of Des Plaines Street in Posen when the individual lost control of his vehicle and struck him. He later died of his injuries.

The plaintiff alleges the defendants failed to call off the chase or pursuit when it was the most reasonable course of action, thereby endangering the safety of others.

The plaintiff seeks judgment in excess of the court's jurisdictional requisite. She is represented by Allen N. Schwartz, Jeffrey C. Schwartz and Michael S. Shinsky of Kralovec, Jambois & Schwartz in Chicago.
