Ashton Center For Day Surgery patient alleges shoulder surgery caused spinal injuries

CHICAGO – A patient alleges improper positioning during a shoulder surgery caused damages to his spine.

Scott Harrell filed a complaint on Dec. 17 in Cook County Circuit Court against 1800 McDonough Road Surgery Center LLC, doing business as Ashton Center For Day Surgery, and others, alleging negligence and other counts.

According to the complaint, on Dec. 15, 2016, Harrell underwent right shoulder surgery at the defendants' facility. He alleges improper positioning before and during the procedure caused herniated cervical disks.

The plaintiff alleges the defendants allegedly improperly positioned him for the shoulder surgery and used improper weights during the positioning for the surgery.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages that substantially exceed all applicable minimum jurisdictional amounts of the court. He is represented by Jon C. Papin of Vrdolyak Law Group LLC in Chicago.
