Patient alleges Aspide Surgimesh XB is defective, caused injury

CHICAGO – An Arkansas woman alleges defectively designed surgical mesh caused her injuries.

Johnna Braun filed a complaint on Jan. 2 in Cook County Circuit Court against Aspide Medical and BG Medical LLC alleging strict liability, negligence and other counts.

According to the complaint, on Aug. 17, 2015, Braun was implanted with Aspide's Surgimesh XB to repair a hernia. The suit states BG Medical is the exclusive U.S. distributor for Aspide's products.

The plaintiff alleges after the surgical implant, she experienced pain and hernia recurrence and had to undergo removal surgery on May 10, 2016.  

The plaintiff alleges the defendants represented that the product was safe for its intended use when they should have known it was not safe.

The plaintiff requests a trial by jury and seeks judgment in excess of the court's jurisdictional requisite. She is represented by Allen N. Schwatz of Kralovec, Jambois & Schwartz in Chicago and others.
