Man sues South West Industries, O'Malley Construction after falling down elevator shaft

CHICAGO – A Columbia College employee has filed suit against two companies associated with an elevator after he allegedly fell down an elevator shaft.

Daniel Baker filed a complaint on Jan. 2 in Cook County Circuit Court against South West Industries Inc. and O'Malley Construction Co. Inc. alleging negligence.

According to the complaint, on Aug. 14, 2017, Baker was working at a Chicago building and attempted to enter a freight elevator from the basement floor. The suit states the plaintiff fell down the elevator shaft when the elevator door opened but the elevator car was not present. As a result, the plaintiff alleges he sustained severe and permanent injuries. 

The suit states South West Industries Inc. was the elevator service contractor for the building at the time of the plaintiff's fall and that O'Malley Construction possessed and operated the elevator at the building.

The plaintiff alleges the defendants improperly maintained the elevator and failed to warn of the dangerous condition.

The plaintiff seeks judgment in an amount to satisfy the jurisdictional limitation of the court and additional amounts, plus costs of suit. He is represented by Adam M. Gilbert of Anesi, Ozmon, Rodin, Novak & Kohen LTD in Chicago.
