BENESCH FRIEDLANDER COPLAN & ARONOFF: Mark Silberman Named Chair of Benesch White Collar Practice

Benesch, Friedlander, Coplan & Aronoff LLP issued the following announcement on Jan. 10.

Benesch is pleased to announce that partner Mark J. Silberman has been named as the Chair of the firm’s White Collar, Government Investigations & Regulatory Compliance Practice Group.  Silberman is also a member of the firm’s Health Care & Life Sciences Practice Group.

“Mark’s ascension to this leadership position is a testament to his work on behalf of our health care clients and his experience and savvy as a former state and federal prosecutor,” said Benesch’s Managing Partner Gregg Eisenberg.  “He brings a unique and innovative perspective to his practice, focusing on helping health systems and businesses navigate the full and complex landscape of their industry, including transactional, compliance and regulatory work, as well as commercial litigation and white collar and enforcement actions.”

Silberman has broad experience with a variety of white collar investigations and actions. His practice focuses on both assisting clients to avoid compliance and regulatory issues as well as litigating those issues when necessary. He has handled internal and external investigations into regulatory compliance, designed and implemented corporate integrity agreements, responded to criminal and civil government inquiries, dismantled and defended False Claims Act allegations, supervised internal and external regulatory audits, audited and implemented compliance plans, and prepared notification and disclosures as necessary following internal investigations into compliance issues. Silberman is adept at navigating government, a skill set upon which his clients rely. His experience allows him to help clients create a compliance framework designed to avoid the avoidable problems, thereby allowing their focus to remain on their chosen business.

Before entering private practice, Silberman served as chief of drug prosecution for the Sangamon County, Illinois, State's Attorney's Office and as a special assistant U.S. attorney in the Central District of Illinois.  His previous government service includes acting as General Counsel to the Illinois Certificate of Need Board and the deputy chief counsel for litigation and enforcement at the Illinois Department of Public Health.

Silberman also serves as the outside General Counsel to the American Association of Nurse Anesthetists.

As department chair, he intends to take a proactive approach to serving clients who might have white collar concerns, “While, of course, we are well-positioned to support clients through government investigations, we can also work with businesses to take proactive steps to avoid government investigations altogether. We provide a critical service to our clients-we help save money and time by addressing government investigations before they even start.  This is a tremendous value for our business-minded clients and I’m thrilled to be leading such a strong team.”   

Silberman’s vision for the firm’s White Collar, Government Investigations & Regulatory Compliance Practice Group reflects continued momentum for Benesch, which has been growing aggressively in Chicago and expanding its national footprint as part of a strategic plan launched by Eisenberg in 2015.  In all, 60 attorneys have joined the firm in the last 18 months, which has also seen the opening of a Chicago office and the expansion of practices including class action litigation, intellectual property litigation and labor and employment.  Since making its debut on the AmLaw 200 list in 2016, the firm has advanced 15 places and is currently ranked at number 180.

Mark graduated cum laude from the University of Illinois College of Law in 1998, and cum laude Brandeis University in 1995.
