Lawsuit alleges North Shore Place failed to keep female resident safe from sexual assault

CHICAGO — An assisted-living facility and its operator and executive director have been sued for alleged common law negligence.

Susan Zimmer, acting as a duly appointed attorney, filed a complaint on Jan. 16 in Cook County Circuit Court against defendants, including BMSH Northbrook Illinois LLC, which does business as North Shore Place;  North Shore Place Senior Lifestyle Management LLC; and Steve Salaman, alleging they were negligent in protecting a female resident from sexual, mental and physical abuse.

According to the complaint, the plaintiff alleges in April 2015, the resident was admitted to North Shore Place for assisted-living services. She was allegedly sexually assaulted by a male resident in May 2018. The plaintiff alleges the defendants knew or should have known the female resident was at a high risk for physical abuse or sexual assault because of dementia and impaired physical mobility. Additionally, she alleges they were negligent in failing to conduct a timely investigation and report the incident to her family, physician and law enforcement.

The plaintiff requests a trial by jury and more than $50,000. She is represented by Kelly Sabo Gaden of the Law Offices of Steven J. Malman & Associates in Chicago.
