CHICAGO — A woman is suing long-term nursing care facilities, citing alleged failure to protect and negligence.
Linda Gates, by her duly appointed power of attorney, Jack Gates, filed a complaint on Jan. 16 in Cook County Circuit Court against Alden Courts of Waterford and affiliated entities for alleged violation of the Nursing Home Care Act.
According to the complaint, in March 2018, Linda Gates was admitted to defendants' nursing home and rehabilitative services. She was allegedly identified to caregivers as a known high risk for falls.
Jack Gates claims despite defendants' knowledge of her condition, Linda Gates fell, sustaining injuries including a left femur fracture and a left ankle fracture, both of which required hospitalization and surgery. These falls were a factor to the deterioration of her physical and mental condition.
The plaintiff requests a trial by jury and seeks more than $50,000, plus attorney fees as allowed by statute. He is represented by Kelly Sabo Gaden of The Law Offices of Steven J. Malman & Associates in Chicago.
