Woman claims Elmwood Park Rehab failed to help spouse, contributing to his death

CHICAGO — An executor of the estate of Gregory W. Lietzau is suing Generations at Elmwood Park, citing alleged violations of the Illinois Survival Statute and Nursing Home Care Act.

Paulette Lietzau filed a complaint on Jan. 17 in Cook County Circuit Court against the defendants, alleging they failed to provide Gregory Lietzau the necessary care and services to prevent a decline in his abilities to perform activities of daily living.

According to the complaint, the plaintiff alleges in October 2017, Gregory Lietzau was admitted to Generations at Elmwood Park. He reportedly suffered from pneumonia, UTI, malnutrition and dehydration while a resident of the facility. He was hospitalized in December 2017 and died in February 2018. 

The plaintiff alleges the defendants should have known Lietzau's history of medical conditions, which could have aided them in assisting him and in developing and implementing a comprehensive and updated assessment plan.

The plaintiff requests a trial by jury and seeks more than $50,000, attorney fees and costs and other relief. She is represented by Lawrence van der Horst of The Clinesmith Firm in Chicago.
