Lawsuit claims Veracare Brentwood failed to properly care for woman with tracheostomy tube

CHICAGO — A man is suing Veracare Burbank, a long-term nursing care facility, citing alleged negligence and wrongful death.

Ray Williams filed a complaint on Jan. 16 in Cook County Circuit Court, alleging, during his relative, Fredester McDaye's, residency at defendant's facility in Burbank, her tracheostomy tube became dislodged. That reportedly resulted in respiratory distress and failure, and deterioration of her physical and mental condition, all of which contributed to her death in April 2018. 

The plaintiff alleges the defendant failed to provide McDaye with properly supervised nursing, respiratory and personal care; failed to develop an appropriate plan of care; and failed to ensure that nurses, therapists and assistants were properly trained to meet her needs.

The plaintiff requests a trial by jury and seeks more than $50,000, plus attorney fees and costs. He is represented by Samantha Israel of The Law Offices of Steven J. Malman & Associates PC in Chicago.
