Late patient's mother claims Heather Health Care Center allowed son to be attacked, injured

CHICAGO — A surviving mother is suing nursing home facilities, citing alleged negligence.

Gloria Donnerson, individually and as next friend of Tyrone T. Stewart, filed a complaint on Jan. 23 in Cook County Circuit Court against Heather Health Care Center Inc. and The Alden Group Ltd. for alleged violation of the Illinois Nursing Home Care Act.

According to the complaint, in January 2017, while a resident and patient at defendants' facility, Tyrone Stewart was allegedly involved in an altercation with another resident in which he was struck in the face and head with a pill crusher, suffering traumatic injuries. He was transported by ambulance to another hospital.

Plaintiff claims residents were not properly supervised, allowing Stewart to be physically injured.

The plaintiff requests a trial by jury and seeks more than $50,000, costs incurred, post-judgment interest and for such other and further relief. She is represented by Marc McCallister of McCallister Law Group in Chicago.
