Chicago Athletic Clubs allegedly violated law by sending unsolicited promo text messages

CHICAGO — Consumers have filed a class action lawsuit against Chicago Athletic Clubs LLC, citing alleged violation of the Telephone Consumer Protection Act (TCPA).

Alexis Nell Maltman filed a complaint individually and on behalf of all others similarly situated on Jan. 22 in Cook County Circuit Court against Chicago Athletic Clubs, alleging the company sent unsolicited text messages to customers and others.

According to the complaint, the defendants allegedly sent promotional text messages to plaintiffs' mobile phones in an attempt to drive consumers to purchase memberships at one of its fitness clubs. Plaintiff claims the company was using equipment that had a capacity to call random or sequential numbers without recipients' prior express consent to be contacted by the company. 

The plaintiffs request a trial by jury and seek judgment against defendant, certify class action, declaratory and injunctive relief, disrgement, statutory and treble damages, and further relief. They are represented by attorney Benjamin Richman, of the firm of Edelson P.C., of Chicago.
