Patient's next of kin claims area facilities violated Nursing Home Care Act

CHICAGO — A resident's next of kin is suing a nursing facility, citing alleged violations of the Nursing Home Care Act.

Kimetha Brunner, on behalf of Darryl Smith, filed a complaint on Feb. 7 in Cook County Circuit Court against Warren Barr South Loop; South Loop Living & Rehab Center LLC; and Legacy Healthcare Financial Services, alleging they did not provide appropriate medical care and services for Smith.

According to the complaint, Smith was a resident of South Loop Nursing Facility from Oct. 5, 2017 to Oct. 14, 2017, when he allegedly developed deep tissue injuries to his back. Since Oct. 19, 2017, Smith has been a resident of Glencrest Healthcare. At Glencrest, Smith, according to the suit, "developed open sores and several pressures ulcers, was not given Activities of Daily Living, was frequently sitting in a dirty diaper and dirty sheets, was abused by a certified nurse assistant, and was scratched on his face." 

The plaintiff requests a trial by jury and more than $50,000, plus attorney fees and costs and other relief. She is represented by Laurence van der Horst of The Clinesmith Firm in Chicago.
