CHICAGO — A woman is suing a nursing facility, citing alleged negligent supervision in the care of a relative.

Amari Moore, as independent administrator of the estate of Kiana Fountain, filed a complaint on Feb. 6 in Cook County Circuit Court against Warren Barr South Loop, for alleged violation of the Nursing Home Care Act.

According to the complaint, in September 2015, Fountain was admitted to defendant's nursing home for rehabilitative services as she was a high risk for respiratory distress. In April 2017, while a resident, Fountain allegedly did not receive enough oxygen from her ventilator, which caused deterioration in her physical and mental condition, resulting in acute respiratory failure and brain death.

The plaintiff requests a trial by jury and seeks more than $50,000. She is represented by Annabelle Borota and David Resis of The Law Offices of Steven J. Malman & Associates in Chicago.

Cook County Circuit Court Case No. 19-L-001331.
