Consumer files class action alleging Chicago Athletic Clubs sent unsolicited text messages

CHICAGO — A consumer has filed a class-action lawsuit against an athletic club, accusing the company of sending illegal spam texts.

Steven Green, on behalf of himself and all others similarly situated, filed a complaint on Feb. 11 in Cook County Circuit Court against Chicago Athletic Clubs LLC for alleged violation of the Telephone Consumer Protection Act.

According to the complaint, on Jan. 11, Green received a spam text message from defendant offering its services without his prior express written consent. Plaintiff claims defendant sent text messages to him and numerous individuals using an automated telephone dialing system. He claims he still received text messages from defendant even after terminating his contract with them.  

The plaintiff requests a trial by jury and seeks statutory damages of $1,500 per violation, injunctive relief, attorney's fees, costs, and other relief. He is represented by Michael Agruss of the Agruss Law Firm in Chicago.
