Class action claims Progressive Insurance fails to pay Actual Cash Value to cover losses

CHICAGO — A class action lawsuit accuses Progressive Insurance of not paying Actual Cash Value for insured losses.

Named plaintiff Karen Jacobson filed a complaint, individually and on behalf of all others similarly situated, on Feb. 13 in Cook County Circuit Court against Progressive Northern Insurance Co.

According to the complaint, Jacobson and others have suffered damages due to its wrongful business practice of refusing to pay full ACV payments or full total loss payment (FTLP) to first-party total loss insureds on physical damage coverage. The complaint alleges this violates the insurance policy agreement. 

The plaintiffs request a trial by jury and seek judgment against defendant for damages; certification of class action; and award of declaratory relief, compensatory damages, attorney fees, expenses, interests and further relief.
