Ex-Do & Co. Chicago laborer claims company violated BIPA by requiring worker fingerprint scans

CHICAGO — A man who worked as a laborer for Do & Co Chicago is claiming the company violated Illinois law by using a fingerprint scan for tracking workers' time and attendance. 

Danny Round, on behalf of himself and all other similarly situated, filed a complaint in November in Cook County Circuit Court against Do & Co Chicago Catering Inc. (D&C) alleging violation of the Illinois Biometric Information Privacy Act (BIPA).

Round's complaint said he worked for D&C as a laborer in 2018 at its Des Plaines location and alleges that he was required to scan his fingerprint when punching in and out of work shifts. He claims he was not informed in writing that his biometric information was being collected, told the purposes or to whom his data was disclosed and that he did not give written authorization for his biometric data to be collected and stored.

Round and the members of the punitive class seek monetary relief of between $1,000 and $5,000, plus attorney fees. They are represented by attorneys Alejandro Cafferelli, Lorie Peeters and Katherine Stryker of Caffarelli & Associates Ltd in Chicago.
