Edna Kersting (Partner-Chicago) succeeded in an arbitration on behalf of a major carrier client in a case involving a beneficiary’s lawsuit pertaining to the adjustment of the death benefit on his mother’s life as the result of an age misrepresentation on her application for coverage. The deceased had represented herself as 13 years younger than she actually was, and at her death, once the misrepresentation was discovered, our client paid only what the premiums would have bought had the company known the insured’s actual age. The plaintiff claimed our client had a pattern and practice of training its agents to encourage misrepresentations on the applications for coverage, which allegedly impacted his mother’s application.
