The owner of Chicago-based Hyde Park Apartments, AIMCO Hyde Park Tower LLC, is being sued in a class action lawsuit alleging that the rental company violated the City of Chicago Residential Landlord and Tenant Ordinance (RLTO).
Under the ordinance, when a security deposit is required and paid by a rental lease, proper documentation must be made of: the amount of the deposit; the name of the person who received it; the name of the landlord for whom the deposit was intended; the date it was received; a description of the rental unit; a signature of the person who received the deposit, the complaint said.
Class Representative Hung-I Lee alleges AIMCO Hyde Park failed to follow the ordinance or adhere to the documentation and notation requirements concerning tenants' security deposits. AIMCO Hyde Park is being sued for one count of failure to give a security deposit receipt, which demands double the security deposit in damages. It is also being sued for a count of failure to attach the required RLTO summaries, which demands $100 per violation.
The complaint seeks to expand the action to include potentially every tenant in the building. The complaint said the building includes 155 apartments.
The suit was filed on Feb. 5 by attorney Jeffrey Sobek, of JS Law, of Chicago.
