Class action accuses apartment management company of violating Chicago landlord, tenant ordinance

Apartment tenants have sued Realty and Mortgage Co. and a number of unidentified landlords for allegedly violating the city of Chicago Residential Landlord and Tenant Ordinance (RLTO), according to documents filed March 2 in Cook County Circuit Court.

Plaintiff and class representative Amanda Hudson is a Chicago resident who formerly lived in an apartment in the 4800 block of S. St. Lawrence Avenue. Hudson paid a $979 security deposit for the unit and was given a security deposit receipt that reportedly did not include the landlord's name or a description of the dwelling unit. 

When Hudson's rental period ended, the defendant allegedly did not pay her back her security deposit. 

The class action accused Realty and Mortgage Co. with failure to give a security deposit receipt in compliance with the RLTO and failure to pay interest on security deposits in violation of the RLTO. 

Violations of the RLTO are subject to damages equal to double the security deposit plus interest per violation. 

The plaintiff is represented by attorney Jeffrey Sobek, of JS Law,  of Chicago.
