Class action: Orland Township campaign illegally sent robo text messages to voters

A candidate for Orland Township Supervisor and a campaign organization backing a slate of allied candidates for the Orland Township Board of Trustees face a class action lawsuit over alleged use of robocalls.

Plaintiff John Carmody filed suit on March 5 in Cook County Circuit Court against Orland Residents for Responsible Government and political candidate Scott Kaspar.

According to the complaint, Kaspar is the managing partner at the Kaspar Law Company, of Chicago. 

Carmody, identified as a Cook County resident, alleges in his complaint that he received unsolicited text messages from the defendants as part of their campaign for election in Orland Township during the upcoming municipal elections in April.

Carmody says he never gave the defendants his cell phone number, or consent to send him text messages. He alleges the defendants' use of a random or sequential phone number generator to send text messages en masse to area residents is a violation of privacy law regulated by the Federal Communications Commission (FCC). 

The complaint accuses the defendants of violating the Telephone Consumer Protection Act, and Carmody seeks $500 in restitution for each alleged text message, for each class member. 

Carmody is represented by attorney Keith J. Keogh, of Keogh Law Ltd., of Chicago.
