Illinois-based debt collector Credit Control LLC faces accusations of violating the Fair Debt Collection Practices Act (FDCPA) in a class action lawsuit filed in Cook County Circuit Court.
According to a complaint filed on March 5, Credit Control LLC received a delinquent credit card balance for plaintiff James Garcia and sent Garcia a letter regarding the debt in November 2020.
Garcia says that the letter was sent in a windowed envelope that showed his name and return address, as well as a barcode and series of numbers next to his address.
Garcia alleges the FDCPA bans the use of any language or symbols other than the debt collector's name and address, and the addressee's name and address.
Credit Control is sued with one count of violating the FDCPA, and the plaintiff seeks statutory damages per violation per member of the class. The complaint does not estimate the number of potential class members, saying that can only be learned through access to the company's records.
