Chicago law firm sued by former client for missed filing deadline in personal injury suit vs American Airlines

Attorney Brian Hercule and the Law Offices of John S. Eliasik have been sued by a former client in a personal injury claim against American Airlines in the Circuit Court of Cook County.

Plaintiff Jesus Solorzano filed suit March 24 in Cook County Circuit Court against the lawyer and firm, accusing them of legal malpractice. 

Solorzano is represented in the new lawsuit by attorney Thomas G. Gorman, of the Krzak Rundio Law Group LLC, and Elliott R. Schiff, of the Schiff Law firm.

According to the new complaint, Solorzano hired the Eliasik firm to represent him in a personal injury suit he brought against American Airlines over injuries he claims he suffered while on a flight that lost cabin pressure in August 2017. 

According to the complaint, Solorzano first met with Eliasik in December 2018 to discuss the suit, at which time they entered into a representation agreement.

However, the new complaint alleges that Hercule and the firm did not file the suit until September 2019. The suit was later dismissed by a federal judge, who ruled it was filed in too late.

In his suit against the Hecule and the firm, Solorzano alleges the defendants “failed to adhere to the standard of care of a reasonably well qualified lawyer practicing in the same locality,” according to court documents. The complaint alleges that Solorzano has been barred from seeking financial relief for his injuries as a result of the defendants' alleged actions.
