A company that owns and manages apartment buildings in Chicago's north and northwest suburbs has been hit with a class action suit, accusing the company of allegedly improperly withholding security deposits from tenants when their lease term expires.
Attorney Berton N. Ring, of Chicago filed suit on March 24 against Casa Apartments LLC, on behalf of named plaintiffs Yelena and Rodion Turovets.
The complaint alleges that the Turovets rented a Casa Apartments residence in suburban Waukegan from November 2019 through October 2020. The former tenants allege that they paid all of their security deposit and rent, and had completely vacated the premises prior to the end of their one-year lease.
However, the Turovets allege that in mid November they were notified by Tony Case – identified as a partner with Casa Apartments – that their security deposit had been “consumed” to cover an early lease termination fee. The complaint also claims that the Turovets should have received interest on the security deposit, which was not accounted for in communication from Casa Apartments.
The suit alleges that Casa Apartments allegedly violated both the Illinois Security Deposit Return Act and the Illinois Security Deposit Interest Act. Additionally, the complaint alleges Casa Apartments also violated portions of the Waukegan City Code related to care and maintenance.
