Debt collector Radius Global Solutions LLC has been hit with a class action accusing the firm of violating the federal Fair Debt Collection Practices Act.
The complaint was filed March 26 in Cook County Circuit Court.
The class is led by plaintiff Sharron Anderson. According to the complaint, lender Wells Fargo allegedly referred Anderson's account to Radius for collection action. When the debt collector mailed Anderson a letter as a notice of the debt, the text in the window of the envelope allegedly included more information than just the debt collector's address, which is prohibited under the FDCPA.
Anderson accuses Radius Global Solutions of violating the FDCPA by allegedly including the name of the original creditor, Wells Fargo, on the envelope.
The plaintiff requests the court order statutory damages paid to all eligible members of the class who have experienced the same alleged FDCPA violation in a letter sent by Radius.
