A class action complaint against Alltran Financial LP accuses the debt collector of violating the Fair Debt Collection Practices Act (FDCPA).
According to the suit filed by plaintiff Araceli Cervantes on March 26 in Cook County Circuit Court, Alltran sent Cervantes a letter in August 11 to collect on the account and wrongfully threatened that the amount she owed may increase daily due to late fees and other charges.
According to the complaint, tt is illegal to charge late fees or otherwise increase the amount owed on a debt that has been accelerated into collections.
Cervantes accuses Alltran of violation of the FDCPA through false representation. The complaint requests damages from the court for herself and any other members of the class who experienced similar FDCPA violations from the debt collector.
The plaintiff is represented by attorney Daniel Brown, of Chicago.
