Elk Grove strip club Heavenly Bodies accused of biometric privacy violations in Cook County court

A class action suit has accused the owners of the Heavenly Bodies Fantasy Sports Bar in suburban Elk Grove Village of violating Illinois' biometrics privacy law.

The lawsuit was filed on March 23 in Cook County Circuit Court against HBS Management Corp. and Loumar Corporation of Elk Grove Village.

According to the complaint, the class is represented by plaintiff Veronica Logan, who worked as a waitress for the defendants at the Old Higgins Inn Heavenly Bodies Fantasy Sports Bar.

Logan says that she and other employers were required to place their fingerprint on a scanner to clock in and out for work. 

The defendants, however, allegedly did not inform the employees of how their biometric data was going to be collected, did not first acquire informed written consent and did not provide a publicly available retention and destruction policy, which the complaint alleged violated the Illinois Biometric Information Privacy Act (BIPA.)

Each negligent or unintentional violation of BIPA is subject to up to $1,000 in civil damages per employee, and each reckless or intentional violation is subject to up to $5,000 in civil damages per employee. 

The plaintiff is represented by attorneys Thomas R. Kayes and J. Dominick Larry, both of Chicago.
