Class action suit in Cook County accuses debt collector of frightening consumers into paying

A class action lawsuit against Midland Credit Management Inc. accuses the debt collector of violating the Fair Debt Collection Practices Act (FDCPA). 

According to the complaint filed on March 25 in Cook County Circuit Court, class representative and plaintiff Debra Stinson was targeted in a collections lawsuit filed by Midland Credit. 

In her new lawsuit, Stinson alleged Midland sends letters to consumers it sues with intent to frighten the consumer into paying the debt or face dire consequences — the entry of a judgment — despite no outstanding summons or a summons that does not require consumer action before the due date. 

The plaintiff has asked the court to order Midland Credit stop the alleged illegal, misleading and intimidating debt collection practices for all consumers in the class. She is also seeking the court to order Midland to pay statutory and actual damages, plus attorney fees. 

She is represented by attorney Daniel Edelman, and others with the firm of Edelman, Combs, Latturner and Goodwin LLC, of Chicago.
