A Winnebago County man has filed a class action suit against collection agency, Unifin, alleging the company engaged in unlawful practices while attempting to collect a debt.

The suit was filed by attorney Daniel A. Edelman, of the firm of Edelman Combs Latturner & Goodwin, of Chicago, on behalf of plaintiff Daniel Thomas in Cook County Circuit Court.

The suit alleges Unifin was attempting to collect Thomas’ alleged credit card debt. In March, the lawsuit alleges, Unifin contracted with a letter vendor to send Thomas a letter regarding the collection.

Thomas alleges Unifin shared Thomas’ personal information with the letter vendor, including his address and details regarding the alleged debt, allegedly in violation of the federal Fair Debt Collection Practices Act (FDCPA.) Thomas alleges he never authorized Unifin to share that information.

The suit alleges that a debt collector providing such information to a third party violates the FDCPA’s clause regarding such electronic communication.

Thomas is seeking statutory damages, fees and costs, and additional monetary relief.
