This webinar will discuss the most significant D&O coverage cases from the second half of 2021. The presenters will discuss three categories of issues they saw emerge in the cases decided in the second half of the year: (1) interpretation of the insured v. insured exclusion; (2) interpretation of the professional services exclusion; and (3) the impact of Delaware decisions on D&O coverage issues. The presenters will also discuss other cases of interest that do not fall into these categories.
The issues presented in the cases include:
- Whether a disgorgement payment to the SEC is considered an uninsured “penalty,” and
- Coverage available for cases brought under the Illinois Biometric Privacy Act
