Cannabis Litigation Trends (1:45 pm - 2:45 pm)

As with any business, one can expect litigation. But in an industry that is considered illegal under federal law, that risk may be heightened. Panelists will discuss the litigation trends they are seeing and what they anticipate encountering next. They will explore RICO and whether business owners and their banks need to live in fear of it, whether CBD is being litigated, what is currently legal and what is being enforced, how vaping challenges no smoking laws, and whether litigation trends suggest anything about class actions in the future.

Cannabis Ethical Considerations (4:00 pm - 5:00 pm)

Cannabis law is rapidly evolving at the state level, but state laws legalizing marijuana remain in conflict with federal law, which continues to classify marijuana as an illegal Schedule 1 controlled substance.

Despite this remaining tension between state and federal laws, the cannabis industry continues to expand, and marijuana-related businesses, now more than ever, need legal guidance in navigating a complex web of laws and regulations, in addition to the usual business legal needs. Many practitioners may be thinking about jumping into the burgeoning field of cannabis law. But cannabis law practitioners or would-be cannabis practitioners need to know the ethical limits and pitfalls that they will likely be facing. Our panelists will provide a lively and informative discussion regarding the ethical considerations for cannabis counsel, providing an overview of ABA model rules, state ethics rules that have (or have not) evolved to meet the challenge of legalized cannabis, and some practical guidance on ethics and risk management in this developing practice area. The program will help you understand the impact of the federal/state conflict, learn how to guide marijuana-related businesses through the complex web of laws and regulations in cannabis law, and gain practical guidance on ethics and risk management in this developing practice area.
