Mark T. Banovetz: Insurance Law
Mark is a partner at Tressler and is a member of the firm’s three-person Executive Committee. His practice includes general litigation, insurance coverage analysis, and coverage litigation. Mark’s practice includes representation of pilots, airports, fixed base operators, maintenance facilities, and aviation suppliers and manufacturers. He also has substantial experience representing energy companies in the defense of claims involving aircraft accidents arising from aircraft impacts with ground based structures. Mark lectures and provides counsel to industries in regard to FAA regulations on the marking and lighting of obstructions under the FAA’s regulation of the national airspace system.
Daniel J. Cunningham: Insurance Law
Dan's practice involves insurance coverage and bad faith litigation stemming from underlying consumer protection claims, privacy claims, intellectual property claims, personal and advertising injury claims, defective product claims and environmental claims. Dan has represented insurers in all aspects of litigation throughout the country and has developed skill in successfully asserting coverage defenses arising out of underlying class action lawsuits. Dan frequently represents insurer interests with regard to coverage disputes arising out of the Telephone Consumer Protection Act, the Fair Credit Reporting Act and the Fair and Accurate Credit Transaction Act. He is also involved in counseling insurers with regard to claims arising under various federal and state statutes governing the protection of personal data.
Danita L. Davis: Insurance Law
Danita is Co-Chair of Tressler's Insurance Practice Group. She also practices with the Litigation Defense Practice Group. Danita represents insurers in matters regarding first party property residential and commercial disputes, commercial general liability coverage, professional liability coverage, liquor liability coverage and employment practices liability coverage, among others. She advises insurers regarding a broad range of matters involving state and federal law throughout the country. She regularly appears in court on both routine and contested matters, participates in oral argument and conducts all facets of discovery and trial preparation. She has many favorable outcomes through dispositive motion practice in cases involving coverage and liability issues. Danita also has experience in alternative dispute resolution, having represented clients in settlement conferences and at mediations and arbitrations. Additionally, she has experience defending policyholders in suits alleging a wide range of claims, including but not limited to, premises liability, general negligence, vicarious liability, wrongful acts, contractual disputes, business torts, wrongful employment practices and wrongful acts and intentional conduct.
Daniel R. Formeller: Insurance Law, Litigation – Insurance
Dan is Chairman of the firm. As a trial lawyer based in the firm’s Chicago office, Dan focuses his practice on business litigation and the resolution of business disputes through mediation and arbitration. Dan handles a wide variety of complex business litigation and counseling, including intellectual property, state and federal securities actions, anti-trust, ERISA, class actions and directors and officers liability matters. He has been lead trial counsel in bench and jury trials in state and federal courts throughout the United States.
Donald G. Machalinski: Aviation Law
Don concentrates his practice in aviation, product, professional and premises liability litigation and his practice also includes insurance coverage litigation. Don has an active casualty trial practice as well as an appellate practice for both liability and coverage matters.
William K. McVisk: Healthcare Law, Insurance Law, Litigation – Insurance
Bill focuses his practice on complex insurance coverage litigation and hospital law and medical liability. He has handled all areas of coverage and bad faith litigation, especially third-party bad faith and coverage litigation involving commercial general liability, professional liability coverages as well as personal lines coverages such as auto and homeowners coverages.
Todd S. Schenk: Insurance Law, Litigation – Insurance
Todd is a member of Tressler's three-person Executive Committee. He is highly experienced in providing insurance coverage counseling and litigation representation to insurance companies. Todd is particularly skilled in handling third party claims involving advertising injury and product liability, and first party claims under residential and commercial property policies. Many of his cases require the defense of common law and statutory bad faith claims, which Todd litigates in venues around the country. He has also handled appeals in both state and federal courts around the country.
Linda J. Schneider: Aviation Law
Linda concentrates her practice in the areas of aviation, product and general civil litigation. She has represented clients in commercial and general aviation matters, including issues of flight instruction, aircraft maintenance and rebuild, component part design and performance, and alleged airline and airport negligence, as well as matters involving the NTSB and the FAA. She has been involved in litigation arising out of the ValuJet Flight 592, Comair Flight 3272, Comair Flight 5191 and Concorde crashes, the Southwest Flight 1248 overrun at Midway Airport, and many other commercial and general aviation accidents and incidents.
Rosa M. Tumialán: Appellate Practice, Insurance Law, Litigation – Insurance
Rosa is a member of the firm’s Insurance Practice Group and focuses her practice on insurance coverage and bad faith litigation. She is an accomplished defense attorney with nearly twenty years of insurance coverage experience. Rosa’s insurer-related services include coverage opinion analysis and representing insurers in complex coverage disputes relating to personal and commercial lines, third party claims, surplus lines as well as claims handling practices and extracontractual liability. Rosa also assists with drafting coverage documents for insurance pools and counsels clients in the administration of same. Her practice also includes serving as national coordinating coverage counsel for insurance clients who rely on her to develop and implement strategies nationwide in response to pattern litigation. Rosa is an accomplished class action defense lawyer and appellate practitioner, having appeared and argued in both state and federal courts nationwide.

Tim is a member of Tressler's three-person Executive Committee and Managing Partner of Tressler's New Jersey office.
